Studio Marie Client Terms and Conditions


1. Booking


A booking is confirmed only once the session fee has been paid and the Client has accepted these Terms and Conditions.


The Photographer reserves the right to refuse or cancel a booking at their discretion.


2. Session Fee and Payment


The session fee is payable at the time of booking.


The session fee secures the agreed date and time and includes the photography session and three digital images.


Additional digital images, client wardrobe upgrades, prints, wall art, albums, or other products purchased separately are subject to additional charges.


All additional purchases must be paid for before delivery unless otherwise agreed in writing.


Where a location chosen by the Client requires entry fees, photography permits, parking charges, or other location-specific costs, these expenses shall be the responsibility of the Client and may be added to the final invoice.


Any significant additional costs will be discussed with the Client and agreed in advance wherever reasonably practicable.


3. Cancellation and Rescheduling


The session fee secures the agreed session date and covers administration, planning, preparation, and reservation of the Photographer's time. For this reason, the session fee is non-refundable in the event of cancellation by the Client.


The Photographer may, at their discretion, offer one rescheduled session date where circumstances reasonably prevent attendance.


Where horses are involved, reasonable circumstances may include illness, injury, veterinary advice, or welfare concerns affecting the horse.


If the Photographer is unable to carry out the session due to illness, injury, equipment failure, severe weather, or circumstances beyond their control, the session will be rescheduled wherever possible. Any rescheduled session must take place within six months of the original booking date unless otherwise agreed in writing by the Photographer.


If rescheduling is not possible, liability shall be limited to a refund of monies paid.


4. Late Arrival


Sessions begin at the agreed time.


Late arrival may reduce the available photography time.


The Photographer is not obliged to extend the session beyond the agreed end time.


5. Conduct, Welfare and Safety


The Photographer reserves the right to pause or terminate a session where behaviour presents a risk to the safety, wellbeing, comfort, or enjoyment of any participant.


The Photographer reserves the right to terminate a session immediately if they reasonably believe that any person or animal is being treated in a manner that is unsafe, abusive, excessively forceful, or likely to compromise welfare.


No refund shall be due where a session is terminated for safety, welfare, or conduct reasons.


The Photographer may be accompanied by an assistant, dress assistant, animal handler, or other support person where required.


The Photographer may suggest poses, locations, movements, interactions, or other creative elements during the session.


All participation is voluntary. The Client remains responsible for deciding whether any suggested pose, activity, location, or interaction is appropriate and safe for themselves and any other participants, animals, or property under their control.


The Client is under no obligation to undertake any suggested pose or activity and may decline any suggestion at any time.


The Photographer reserves the right to modify, withdraw, or discontinue any suggested pose, activity, or location where, in the Photographer's reasonable opinion, it presents a safety, welfare, or practical concern.


The Photographer reserves the right to reschedule a session where weather conditions are considered unsuitable, unsafe, or likely to adversely affect the quality of the session. The Photographer's decision regarding weather suitability shall be final.


The Photographer may photograph Clients riding with or without a riding hat, body protector, or other safety equipment at the Client's request. The decision whether to wear a riding hat, body protector, or other safety equipment remains entirely the responsibility of the Client.


The Photographer does not provide safety advice and shall not be responsible for any injury, loss, damage, or claim arising from the Client's decision to wear or not wear any item of safety equipment.


6. Equine Sessions


Where horses are involved, the Client remains responsible for the handling, control, and welfare of the horse at all times.


The Client agrees to disclose any known behavioural concerns, medical issues, or factors that may affect the safety of the session.


The Photographer reserves the right to modify, pause, or terminate any activity that, in the Photographer's reasonable opinion, presents a safety or welfare concern.


The Photographer's decisions regarding safety and animal welfare shall be final.


The Client is responsible for obtaining any permissions required for locations owned by third parties unless otherwise agreed. The Client confirms they have the owner's permission for any animal participating in the session.


The Photographer shall not be responsible for veterinary, medical, transport, or other costs arising from incidents occurring during the session.


The Client is responsible for ensuring that horses, tack, and equipment presented for the session are clean, safe, and in a suitable condition for photography.


Reasonable grooming marks, dust, mud splashes, seasonal coat changes, and normal signs of horse ownership are expected and may remain visible in final images.


Extensive cleaning, retouching, removal of dirt, stains, damaged equipment, or other avoidable imperfections may not be included as part of the Photographer's standard editing process and may incur additional editing fees where requested.


Location Permissions and Suitability


The Client is responsible for ensuring that any location chosen for the session is suitable for the intended activities and that all necessary permissions have been obtained.


Where the session involves horses, the Client is responsible for checking and complying with any applicable restrictions, access requirements, bylaws, tide times, seasonal regulations, landowner permissions, or other conditions relating to the use of the chosen location.


The Photographer may offer guidance based on their experience, but accepts no responsibility for verifying access rights, permissions, legal requirements, or the suitability of a location for horses, riders, vehicles, or other participants.

7. Artistic Style


The Client acknowledges that they are familiar with the Photographer's portfolio, style, editing approach, and body of work.


Photography and image editing are artistic processes. Final images are created according to the Photographer's professional and creative judgement.


Requests for specific poses, locations, or image styles will be considered but cannot be guaranteed.


The Photographer reserves the right not to deliver images that, in the Photographer's professional judgement, do not meet quality standards or are considered duplicates, test shots, accidental captures, images affected by blinks, poor expressions, technical issues, or other factors affecting image quality. RAW and unedited images from the session are the property of the Photographer and will not be provided under any circumstances. 

The Photographer's editing style is intended to enhance the image whilst preserving the natural appearance of the Client, horse, and environment.


Standard editing may include adjustments to colour, exposure, contrast, cropping, and the removal of temporary blemishes or distractions such as spots, scratches, bruises, stray hairs, or other temporary marks at the Photographer's discretion.


The Photographer does not provide body reshaping, body slimming, body enlargement, facial reshaping, or other alterations that materially change a person's natural appearance.


Requests for extensive retouching or digital manipulation may be declined or may be subject to an additional editing fee where agreed.


8. Image Selection and Delivery


Edited Proof galleries will normally be delivered within four weeks of the photography session.


Proof images are supplied solely for viewing and image selection purposes.


Proof images, including watermarked images, screenshots, previews, screen recordings, and reduced-resolution files, may not be screenshot, copied, reproduced, printed, shared, distributed, published, or otherwise used.


No licence is granted for the use of proof images.


Only final included or purchased images supplied by the Photographer may be printed, shared publicly, or otherwise used.


The Client must select their three included digital images and notify the Photographer of any additional images they wish to purchase within 30 days of gallery delivery unless otherwise agreed.


Once image selections have been received and payment for any additional purchases has been made, final high-resolution images will normally be delivered within seven days.


Only final purchased high-resolution images supplied by the Photographer are suitable for printing.


The Photographer accepts no responsibility for the quality of any prints, products, enlargements, or reproductions created from proof images, screenshots, watermarked files, social media downloads, or any image not supplied as a final purchased high-resolution file.


The Photographer cannot guarantee exact colour reproduction between electronic devices, monitors, mobile phones, tablets, and printed products. Minor variations in colour, brightness, contrast, and appearance shall not constitute a defect.


9. Image Storage


The Photographer will retain final edited images for a maximum of six months following delivery.


Long-term archiving is not guaranteed and Clients are responsible for creating their own backups upon receipt.


10. Copyright and Licensing


Copyright in all images remains the property of the Photographer.


The Client's use of purchased images is governed by the Studio Marie Digital Image Licence.


Purchased images may not be used to train, develop, test, improve, or otherwise contribute to any artificial intelligence, machine learning, image generation, facial recognition, or similar automated systems without the Photographer's prior written permission.


11. Alteration of Images


Images may not be significantly altered, filtered, manipulated, or edited in a way that materially changes the Photographer's work without written permission.


12. Cooperation of Participants


The Photographer cannot guarantee specific poses, expressions, behaviour, cooperation, or outcomes from participants, children, animals, weather conditions, or environmental factors.


No refund shall be due where these factors affect the final images.


13. Client Wardrobe


The Client Wardrobe consists of a collection of handmade, upcycled, and vintage garments available for use during photography sessions.


Use of a Client Wardrobe garment is subject to an additional fee of £30 per person, per dress.


Suitability and Comfort


The Photographer will make reasonable efforts to assist the Client in selecting a suitable garment prior to the session.


If, upon trying on the garment at the session, the Client decides they do not feel comfortable wearing it, the Client may choose not to use the garment.


In such circumstances, the Photographer will refund 50% of the Client Wardrobe fee, provided that:


* No photographs, videos, screenshots, or other recordings have been created of the Client wearing the garment.

* The garment has not been worn beyond the fitting process.


The remaining 50% of the Client Wardrobe fee will be retained to cover preparation costs, including cleaning, steaming, ironing, transport, and session preparation.


Any refund due in these circumstances will be processed within 7 working days of the session.


Care of Garments


The Client agrees to take reasonable care of any garments provided by the Photographer during the session.


Normal outdoor use, including contact with grass, soil, mud, sand, horsehair, and similar environmental conditions reasonably associated with outdoor photography, shall not be considered damage.


Damage


The Client may be held responsible for the reasonable cost of repair or replacement where damage is caused by deliberate misuse, reckless behaviour, or failure to follow reasonable instructions given by the Photographer.


Any claim for repair or replacement shall be limited to the actual and reasonable cost incurred by the Photographer.


Safety


The Photographer reserves the right to discontinue the use of any garment if, in the Photographer's reasonable opinion, its use presents a risk to the safety or welfare of any person, horse, animal, or participant.


The Photographer's decision regarding safety and welfare shall be final.


Where a garment is discontinued due to an unforeseen safety or welfare concern, and the Client has provided accurate information regarding the suitability of the horse and participant, 50% of the Client Wardrobe fee will be refunded.


No refund shall be due where the Photographer reasonably believes that inaccurate, incomplete, or misleading information provided by the Client contributed to the safety concern.


Where a planned element of the session cannot proceed due to safety or welfare concerns, the Photographer may, at their discretion, modify the session, substitute an alternative approach, continue without that element, or reschedule the session where appropriate.


No specific pose, outfit, location, horse behaviour, or creative outcome can be guaranteed.


14. Image Use by the Photographer


Permission for the Photographer to use images for portfolio, website, social media, marketing, advertising, competition entry, publication, or promotional purposes shall be governed by the Client's signed Image Use Consent Form.


Where permission is declined, the Photographer will respect that decision.


15. Limitation of Liability


The Photographer shall take reasonable care in providing services.


In the unlikely event of total photographic failure, equipment malfunction, corruption of digital files, illness, accident, or circumstances beyond the Photographer's reasonable control, liability shall be limited to the return of monies paid.


The Photographer shall not be liable for indirect, consequential, or incidental losses.


Nothing within these Terms shall exclude liability where such exclusion is prohibited by law.


16. Privacy


Client information will be stored and processed in accordance with applicable UK data protection legislation and the Studio Marie Privacy Policy.


17. Acceptance


Payment of the session fee, participation in the session, or purchase of any images or products constitutes acceptance of these Terms and Conditions.


18. Entire Agreement


These Terms and Conditions, together with any signed forms, licences, consents, policies, invoices, and written correspondence relating to the booking, constitute the entire agreement between the Photographer and the Client and supersede any prior discussions or understandings.


19. Severability


If any provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

1. Digital Image Purchases

All digital image purchases are subject to the Photographer's Client Terms and Conditions and Digital Image Licence.


Purchased digital images will be supplied in high-resolution digital format via online gallery delivery.


The Photographer retains copyright in all images.


Purchase grants the Client a personal-use licence only.


2. Proof Images

Proof images are supplied solely for viewing and image selection purposes.


Proof images, including watermarked images, screenshots, previews, screen recordings, and reduced-resolution files, may not be copied, reproduced, printed, shared, distributed, published, or otherwise used.


No licence is granted for the use of proof images.


Only final purchased images supplied by the Photographer may be printed, shared publicly, or otherwise used.


3. Delivery

Proof galleries will normally be delivered within four weeks of the photography session.


Once image selections have been received and payment for any additional purchases has been made, final high-resolution images will normally be delivered within seven days.


4. Refunds

Due to the custom nature of photography services and digital products, digital image purchases are non-refundable once delivered.


5. Third-Party Print Services

Where print products are ordered through third-party providers integrated with the online gallery, the fulfilment, manufacture, delivery, and quality of those products are the responsibility of the relevant supplier.


Any issues relating to print fulfilment should be raised directly through the supplier's support process where applicable.


The Photographer accepts no liability for products, services, delays, or errors arising from third-party suppliers.


Only final purchased high-resolution images supplied by the Photographer are suitable for printing.


The Photographer accepts no responsibility for the quality of any prints, products, enlargements, or reproductions created from proof images, screenshots, watermarked files, social media downloads, or any image not supplied as a final purchased high-resolution file.


6. Limitation of Liability

The Photographer's liability shall not exceed the amount paid for the relevant digital product.


Nothing in these Terms excludes liability where such exclusion is prohibited by law.



Digital Images License

The Photographer retains full copyright of all images.


Upon purchase, the Client is granted a non-exclusive, non-transferable licence for personal use only.


This licence permits the Client to:


Download and store the purchased images.

Share purchased images on personal social media accounts.

Print purchased images for personal display and enjoyment.

Share purchased images with family and friends.

This licence does not permit the Client to:


Sell, licence, or transfer the images to any third party.

Use the images for commercial, business, advertising, promotional, editorial, or marketing purposes.

Submit the images to stock photography websites.

Enter the images into competitions on behalf of third parties.

Images may not be significantly altered, filtered, manipulated, or edited in a way that materially changes the Photographer's work without the Photographer's written permission.

Remove watermarks, copyright notices, or branding from any image.

Copyright remains with the Photographer at all times.


Any commercial use of the images requires the Photographer's prior written consent and may be subject to additional licensing fees.
